According to court papers in Westchester County, a settlement of $10 million has been agreed by WalMart for the children of James McNair, the comedian who was killed in the New Jersey Turnpike crash that injured Tracy Morgan.
James McNair lived in White Plains until he died on June 7 when he was on his way home from a show in Delaware when a WalMart truck hit the limo van he, Morgan and others were travelling in.
Morgan suffered a traumatic brain injury and broken bones and is still in rehabilitation working on his recovery. He along with two others injured in the crash have also sued WalMart and the driver of the truck has been charged with death by auto and other offenses. The initial investigation shows that he was speeding at the time of the accident.
The award was originally confidential but it was recently mentioned in court papers filed for a request for $3 million in legal fees.
